There have been three public informational meetings regarding the proposed zoning of the townships and boroughs of the Eastern Susquehanna County Partnership. There were many comments. Here you may comment or ask questions.
Ararat Township approved a portion of Dunn Lake for commercial development. Specifically, it was approved for a 30 room inn, a 50 seat tavern, a 75 seat restuarant and a 200 seat banquet facility. The DEP approved waste water treatment plant was sized to accomodate the commercial use.
In looking at the proposed zoning map, I do not see any portion of Dunn Lake zoned commercial.
Since the township has already approved commercial development on Lot 11A of Dunn Lake, why does the zoning map not reflect this?
That is a good question Daniel. The development of the ESCP Zoning Ordinance and Map is based upon the findings and information gathered during the preparation of the Comprehensive Plan. Existing Land Uses were identified and mapped in an effort to categorize uses common in a given area. Sections that contain residential uses were generally mapped as Residential, retail uses as Commercial and State Game Lands were identified as Open Space/Recreation, etc. This became the foundation for the Zoning Districts. The Districts represent the predominant land use in the area as well as future land use.
When any Zoning Ordinance is adopted, certain structures and land uses may not meet the regulations. These are nonconforming uses, lots, or structures. They are allowed to continue, can be sold to another owner, and are given protection in the Ordinance. Generally, nonconforming uses (Grandfathered Uses) are unique to an area such as a commercial use in a predominantly residential area.
Further, the State does not permit “spot zoning” so we are unable to have one district for one business.
